IN ACCORDANCE WITH THE MANITOBA ENVIRONMENT ACT (C.C.S.M. c. E125)
THIS LICENCE IS ISSUED PURSUANT TO SECTION 11(1) TO:
TEMBEC INDUSTRIES INC.; the "Licencee"
for the construction and operation of Phase 1 only of the Development known as the Lake
Winnipeg Forest Access Road East located east of Lake Winnipeg. The Development begins in
the southern portion of Section 2 Township 31 Range 06 EPM and extends in a northerly
direction to a termination point located one kilometer or more from the Bloodvein River
subject to the following specifications, terms and conditions:
- The Licencee shall construct the Development in accordance with the preferred Corridor
"A" as shown in the Environment Act Proposal of the Lake Winnipeg East
Forest Access Road, dated November 20, 1995.
- The Licencee shall, during and upon completion of construction of the Development,
ensure that no clearing or other disturbance occurs between the termination point of the
Development to the shoreline of the Bloodvein River, a minimum distance of one kilometer.
- The Licencee shall, prior to right-of-way clearing of the Development, ensure that the
road right-of-way is reserved on the Crown Land Registry system and that all appropriate
timber and work permits from Manitoba Conservation are obtained.
- The Licencee shall, prior to clearing and construction of the Development, consult and
receive approval from the Integrated Resource Management Team (IRMT) and the Eastern
Region, of Manitoba Conservation, with respect to clearing and construction timing, site
and design considerations and mitigative actions for right-of-way clearing and
construction methods.
- The Licencee shall ensure that all contractors working on the Development maximize their
use of the existing winter road system for access during clearing and construction
activities associated with the Development.
- The Licencee shall, during construction, adhere to the general recommendations on
design, construction and maintenance of stream crossings as specified in the Manitoba
Department of Conservation guidelines titled Recommended Fish Protection Procedures
for Stream Crossings in Manitoba.
- The Licencee shall, during the execution of any works associated with the Development
involving the use of explosives, ensure that the work is conducted consistent with
Fisheries and Oceans Canada Guidelines for the Use of Explosives in Canadian Waters.
- The Licencee shall, during clearing the right-of-way over streams where temporary
corduroy re-enforcement is required, use only delimbed logs to facilitate removal of the
stream crossing in the spring.
- The Licencee shall, after clearing is complete and prior to spring breakup, remove
temporary stream crossings associated with the Development.
- The Licencee shall during construction of the Development undertake measures to ensure
that runoff containing suspended soil particles and construction debris does not enter any
watercourse.
- The Licencee shall not undertake any construction or maintenance activities in or
adjacent to streams or other water bodies between April 1 and June 30 of any year, unless
otherwise approved by the Manitoba Conservation Regional Fisheries Manager.
- The Licencee shall schedule the construction of any permanent stream crossings
associated with the Development between July 1 to September 30 of any construction year to
avoid fish spawning periods. Any alteration to this schedule shall require approval by the
Manitoba Conservation Regional Fisheries Manager.
- The Licencee shall, during construction, ensure that all fuel storage areas established
for the construction of the Development shall comply with the requirements of Manitoba
Regulation 97/88R respecting Storage and Handling of Gasoline and Associated
Products.
- The Licencee shall ensure that construction or maintenance machinery used in association
with the Development are not fueled within 100 meters of any water body and that any
vehicle maintenance or repair done in conjunction with the Development is performed in an
area constructed and equipped especially for that purpose.
- The Licencee shall ensure that all used oil products and other regulated hazardous
wastes generated by the machinery used in the construction and maintenance of the
Development are collected and disposed of in accordance with all applicable regulatory
requirements.
- The Licencee shall during the full term of the construction of the Development, cleanup
and deposit all non hazardous waste and debris from the construction activities into a
waste disposal ground operating under the authority of a permit issued pursuant to the Manitoba
Regulation, MR 150/91 respecting waste disposal grounds.
- The Licencee shall, at the completion of construction, revegetate all areas disturbed
during construction with native plants or cultivars in order to minimize soil erosion as
directed by the Manitoba Conservation Integrated Resource Management Team.
- The Licencee shall use mechanical or other non-chemical means to control unwanted
vegetation for the Development.
REVIEW AND REVOCATION
- This Licence replaces Licence No. 2155 which is hereby rescinded.
- If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or
is failing to meet the specifications, limits, terms, or conditions set out in this
Licence, the Director may, temporarily or permanently, revoke this Licence.
- If, in the opinion of the Director, new evidence warrants a change in the
specifications, limits, terms or conditions of this Licence, the Director may require the
filing of a new proposal pursuant to Section 11 of The Environment Act.
