THIS LICENCE IS ISSUED TO:
DON ORCHARD; "the Licencee"
for the construction and operation of the Development being a
headwater retention dam in NW 15 and NE 16-5-7W and in accordance with the Proposal filed under The Environment Act dated June 27, 1996, and subject to the following specifications, limits, terms and conditions:
GENERAL TERMS AND CONDITIONS
This Section of the Licence contains requirements intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.
- The Licencee shall ensure that all used oil products and other regulated hazardous wastes generated by the machinery used in the construction and operation of the Development are collected and disposed of in accordance with applicable Manitoba Environment and legislation requirements.
- The Licencee shall, during construction and operation of the Development, ensure that appropriate measures are taken to prevent the entry of sediment due to water erosion into the waterway downstream of the Development.
- The Licencee shall ensure that areas of the Development which are exposed to high velocity flows are stabilized with clean riprap.
- The Licencee shall reseed soil exposed during the construction of the Development with species and/or cultivars of native grasses or legumes.
SPECIFICATIONS, LIMITS, TERMS AND CONDITIONS
- The Licencee shall not undertake construction of the Development until a heritage resources field investigation has been undertaken at the site of the Development by the Historic Resources Branch.
- The Licencee shall not undertake construction or maintenance activities which may result in siltation or sediment deposition in the waterway downstream of the Development between April 1 and June 15 of any year, or during heavy precipitation events.
- The Licencee shall notify the South-Central office of Manitoba Environment of the intended starting date of construction of the Development not less than one week before the start of construction.
- The Licencee shall ensure that any seams of aggregate material within the reservoir area exposed by the construction of the Development are sealed with clay to prevent the seepage of surface water into groundwater supplies.
- The Licencee shall ensure that fuel storage areas established for the construction and operation of the Development are located a minimum distance of 100 metres from any waterbody, and shall comply with the requirements of Manitoba Regulation 97/88R respecting Storage and Handling of Gasoline and Associated Products.
REVIEW AND REVOCATION
- If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or is failing to meet the specifications, limits, terms, or conditions set out in this Licence, the Director may, temporarily or permanently, revoke this Licence.
- If construction of the development has not commenced within three years of the date of this Licence, the Licence is revoked.
- If, in the opinion of the Director, new evidence warrants a change in the specifications, limits, terms or conditions of this Licence, the Director may require the filing of a new proposal pursuant to Section 11 of The Environment Act.
