THIS LICENCE IS ISSUED PURSUANT TO SECTION 10(1) TO:
THE RURAL MUNICIPALITY OF ST. CLEMENTS "the Licencee"
STAGE 1 LICENCE
Approval is hereby given for the siting and construction of the
Development being a Class 1 Waste Disposal Ground located in the East half Section 29-15-7E of the Rural Municipality of St. Clements, and bordered on the East by the East boundary of Section 29-15-7E; on the North by a line parallel to, and 50 metres South, of the North boundary of Section 29-15-7E; on the West by a line parallel to, and 600 metres west, of the East boundary of Section 29-15-7E and on the South by a line parallel to, and 1,050 metres South, of the North boundary of Section 29-15-7E in accordance with the Proposal filed under The Environment Act on March 21, 1996 and subject to the following
specifications, limits, terms and conditions:
In this Licence,
"access road" means a road that leads from a Provincial Trunk Highway, Provincial Road, or a municipal road;
"active area" means a designated trench or berm confined area of a waste disposal ground in which solid wastes are deposited;
"approved" means approved in writing;
"body of water" includes any body of flowing or standing water whether natural or artificially created;
"cell" means a deposit of waste that has been covered by cover material so that no waste deposited in the cell is directly exposed to the atmosphere;
"compliance boundary" means the planar surface that circumscribes the Development, extends vertically downward from the land surface, and constitutes the place at which the parameters of the background water quality as specified in a Licence issued pursuant to The Environment Act by the Director, are not to be exceeded;
"director" means a Director designated under The Environment Act;
"dwelling" means a building or part of a building that is used for living or business purposes and includes a mobile home;
"groundwater" means water below the surface of the ground saturating a zone of the earth's mantle;
"leachate" means liquid that has percolated through solid waste, and that contains dissolved and suspended materials from such matter;
"liner" means a continuous layer of reworked soil, or man-made materials beneath and on the sides of a land disposal facility, compost facility, or storage area and that restricts the downward or lateral escape of solid waste, leachate, and gas;
"liquid waste" means sewage, sewage effluent and sludge from septic tanks, holding tanks and municipal sewage treatment systems and that has a slump of more than 150 mm using the slump test method (slump test, C.S.A. Standard Test Method A23.1-5C);
"monitoring point" means any installation or location used to determine the quality or physical characteristics of groundwater, surface water, or water in the unsaturated zone;
"notify" means notify in writing;
"site" means the area both permanent and temporary which is required for the construction and operation of a Class 1 Waste Disposal Ground, borrow areas, and such undefined contiguous areas as may reasonably be considered to be subject to impact from the activities of the Class 1 Waste Disposal Ground; and
"water table" means the surface of the groundwater at which the pressure is atmospheric.
GENERAL TERMS AND CONDITIONS
This Section of the Licence contains terms and conditions intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.
- The Licencee shall ensure that, the eastern boundary of the Development is located at least 4.8 kilometres from the Greenwald Colony hog operation.
- The Licencee shall ensure that access to the Development is only from 59 Highway to the West along Road 88N, and from PTH 317 to the South along Road 37E.
- The Licencee shall ensure that surface drainage from all access roads to the Development is constructed to divert surface runoff from the site and leads to the adjoining access road drainage system.
- The Licencee shall ensure that drainage from the site is not directed to the Brokenhead River.
- The Licencee shall undertake detailed investigations, for submission to the Director, of the specific land filling area to determine the geological and hydrogeological conditions at such areas.
- The Licencee shall provide calculations, for submission to the Director, of safe excavation depths and detailed designs to prevent blowouts, floating of the liner and slope instability for individual cells for the disposal of wastes.
- The Licencee shall meet, prior to construction, with the Department of Natural Resources (Central Regional Office, Gimli) on matters related to the use of Crown lands to address concerns including the clearing of Crown lands, the utilization of timber from the site, and the re-routing of the existing snowmobile trail.
- The Licencee shall ensure that measures are taken to accommodate any excess volume of surface drainage that may affect the capacity of the first order drain to the west of the waste disposal site.
GENERAL SPECIFICATIONS
- The Licencee shall submit, prior to construction, for the approval of the Director, six sets of engineering design plans in respect of the Development. The engineering design plans shall address construction specifications and include, but not be limited to the following:
- temporary structures to intercept surface drainage from the fill area;
- leachate management system;
- gas migration control system;
- design of the land filling method proposed showing the following:
- the depth of fill;
- the depth of the highest water table below the proposed bed of the landfill area based on stated historical records;
- the proposed number of phases, and the size of each phase;
- the direction of filling as it relates to prevailing winds;
- the slope of the bottom of the fill; and
- the final contours;
- the location of the following:
- access roads to the development;
- site drainage system;
- compliance boundary;
- groundwater monitoring points;
- leachate detection system;
- special waste handling areas excluding hazardous wastes as defined under Chapter D 12 of The Dangerous Goods Handling And Transportation Act; and
- recycling areas; and
- the design and accompanying design reports of the following:
- groundwater monitoring points;
- leachate detection and collection system;
- methane monitoring system;
- methane migration control system;
- liner systems;
- the cover system;
- the litter control fence;
- site drainage system;
- a description of the leachate management system including a water balance analysis to estimate the volume of leachate generated with supporting calculations based on the estimate of waste received on the site, and the selected waste to cover ratio; and
- the volumetric capacity of the waste disposal site, with supporting calculations indicating the waste to cover ratio used for such calculations.
- The Licencee shall submit, for the approval of the Director, six sets of site plans drawn to a scale of 25 metres to the centimetre with 1.5 metres contour intervals in respect of the Development. The site plans shall include but not be limited to the following:
- the location of the access roads to the Development;
- the location and elevation of a permanent benchmark on the site;
- the location and proposed buildings on the site with respect to the boundaries of the waste disposal site;
- the location of transmission lines, underground and surface mines, oil and gas wells existing or abandoned on the site;
- the location of proposed transfer stations;
- the location of the boundaries of all proposed active areas in relation to the boundaries of waste disposal site;
- on-site potable water wells;
- any rock outcroppings;
- the location and design of measures that will be taken to prevent surface water from entering the waste disposal ground;
- the location of the nearest potable water well surrounding the boundary of the waste disposal site to a minimum distance of 2000 metres;
- the location of the boundary of the R.M. of Brokenhead;
- the location of fill areas and borrow areas; and
- on-site roads at all phases of the development.
- The Licencee shall submit to the Director for review, six sets of an Operations Manual providing a description of the activities associated with the operations and management of the waste disposal ground.
LIMITS, TERMS AND CONDITIONS
- The Licencee shall not operate the Development until a Stage 2 Licence is issued by the Director pursuant to The Environment Act for that purpose.
REVOCATION
- The Director may suspend or withdraw the site and
construction approval where, in respect of the proposed waste disposal ground for which site approval has been given, there is a change of circumstances pertaining to the site or new information is received by the Director in respect of the site, or in respect of the intended operations of the proposed waste disposal ground.
