OVERVIEW:
On February 16, 1996, the Manitoba Environment received a Proposal dated February 14, 1996, to upgrade and operate an Agricultural Chemical Formulating Plant, a crop protection warehouse, three solvent tank farms, a plastic container molding facility, and distribution facilities located at 945 Marion Street in the City of Winnipeg. This development has been in operation at this site since 1948 and operated under The Clean Environment Commission Order No. 930 issued on October 13, 1981. The existing development consists of 80,000 sq.ft. of building. It is comprised of 28,000 sq.ft. for formulating, blending of liquid and dry agricultural pesticides; 34,200 sq.ft. of warehouse storage for packing materials; 8900 sq.ft. leased to LMG Reliance for blow moulding plastic containers; and 8900 sq.ft. as CPI certified Phase III agricultural chemical storage. In addition there are the three tank farms surrounding the development which are used for the storage of solvents and technical agricutural chemicals. The total capasity of the tank farms is approximately 212,000 gallons. The expected hours of operation will be 8 hour shifts from June to January and 24 hour continuous operation during the December to May period.
No public concerns were received in response to the advertisement of this proposal in the Winnipeg Free Press published on March 2, 1996. The proposal was placed in the Public Registries at Main & Centennial Public Libraries and Manitoba Eco-Network. The proposal was distributed to TAC on February 27, 1996 with the closing date for TAC and Public comments on March 28, 1996.

COMMENTS FROM THE TECHNICAL ADVISORY COMMITTEE:
Canadian Environmental Assessment Agency state that based on their staff survey, application of the Canadian Environmental Assessment Act with respect to this proposal is not required.
Natural Resources - Policy Coordination Branch has reviewed the proposal and states the site is underlain by a reasonably thick layer of clay and till which should provide temporary protection to the aquifer should a spill or fire occur.
Culture, Heritage and Recreation - Historic Resources has no concern with regard to its potential impact on heritage resources.
Highways state they have reviewed the proposal and have no concerns regarding the development.
Health concerns include what products were actually being handled onsite, and how the chemicals were being transported in and out of the development. In addition they are concerned about the type of spills to occur and methods used in cleanup. They requested further information regarding dyking and berming and the methods used to monitor air emissions as well as soil and wastes.
Disposition
Concerns and questions were forwarded to the proponent for response. Additional information was received from IPCO in reply to the questions raised.Urban Affairs stated they had no comment in regard to this proposal.
Environmental Management Air Quality Management has several comments and questions. Information requested includes the location of nearest residents and other potential public receptors such as schools and hospitals. In addition they questioned the existance of exhaust vents for air quality control and/or any air pollution control equipment or any potential for fugitive emissions resulting from the process or spills. They questioned the quantities of materials processed and stored on the development. They enquired as to the emergency response to spills/fires at the tank farms. A concern was related to the monitoring of air emissions, methods used, and meeting our department guidelines. Water Quality Management listed some concerns in regard to flow, containment, and disposal of potentially contaminated water. Concern was for a catch basin, south of the CPI warehouse that enters into the City of Winnipeg's sewer system which is equipped with an isolation valve capable of being closed during an emergency. They recommend that this valve be regularly be inspected and maintained.
Disposition
The comments, questions, and concerned were forwarded to the proponent for response. Additional information was supplied by IPCO in response to the concerns.Environmental Operations state that the potential risks at this facility warrant a more detailed proposal. They state the site is listed as a contaminated site, with a remediation proposal submitted by Sentar Consultants. They request further information, construction specifications of the tank and piping design standards, spill containment features and any related items such as overflow alarms, spill sumps, etc. Their emergency response plan should be submitted and reviewed.
Disposition
The comments, concerns were forwarded to the proponent for response. An additional report addressing the concerns was submitted by IPCO.
PUBLIC HEARING:
No public hearing will be conducted.
RECOMMENDATION:
Additional information was supplied by the proponent in reponse to TAC requests. Other TAC concerns are addressed in the draft licence.
The responsibility for enforcement of the Licence should remain with Approvals Branch until the proponent complies with Clauses 1, 2, 13, 17, 18, and 19.
A draft Environment Act Licence is attached for the Director's consideration.
