OVERVIEW:

The proposal was dated March 11, 1996 and received on March 15, 1996.

The proposal relates to the collection of used oil at the Town of Minnedosa WDG in a double walled 1000 gallon tank. The oil will be accepted from residents of the Town of Minnedosa and the R Ms of Minto, Odanah and Saskatchewan. The collected used oil will be sent by Licenced Carrier to a recycling facility or disposal facility.

After internal review, the proposal was advertised in the Minnedosa Tribune on April 16, 1996, and also placed in the following Public Registries: Main Registry, Eco-Network, Western Manitoba Regional Library (Brandon) and the Centennial Public Library.

The closing date for public comment was May 9, 1996.

The proposal was sent to TAC on April 10, 1996 with a response closing date of May 9, 1996.

COMMENTS FROM THE PUBLIC:

There were no comments received from the public in response to the advertisement.

COMMENTS FROM THE TECHNICAL ADVISORY COMMITTEE:

Manitoba Environment, Environmental Operations Division, Park West Region commented that the operation of the Town of Minnedosa WDG is presently under review. The site is located in a ground water hazard area and the operator, the Town of Minnedosa, has been requested to demonstrate suitability of this site. Piezometers have been requested to provide additional information, due July 1, 1996.

There is a high probability the operator of the WDG will be given two options:

  1. Relocate the WDG and develop a new WDG pursuant to regulation and guidelines, or
  2. Develop an engineered designed clay or synthetic liner for an active area at higher elevation on the current site, after capping off and closing the current active area, and to provide a leachate collection system.

The proposal of a used oil collection facility, it is suggested, should not be approved until the site investigation and suitability has been determined.

Disposition:
Through the summer and early fall, a consultant installed piezometers at the WDG and samples of ground water were extracted. On November 14, 1996 the Director of the Park West Region informed Approvals that he recommended that approval be given for the used oil collection facility.

Manitoba Environment, Environmental Management Division, Air Quality Management noted that no information is provided in the proposal detailing:

Disposition:
The concerns about security of the facility will be addressed in the Director's Order. The used oil will be sent for recycling or disposal at "licenced" facilities.

Department of Rural Development had no concerns.

Department of Natural Resources had the following comments:

The site location is in close proximity to the Minnedosa River which is an important fisheries habitat and fish-bearing stream. The topography would suggest that surface run-off and subsurface drainage would drain towards the Minnedosa River. To ensure containment of leachate or spill material, the proponent should consider using an impervious material underneath the structure, installing a dike system around the site and placing ditch plugs into the drainage ditching where necessary.

Disposition:
The used oil will be collected in a double walled tank which is considered to be equivalent to a diked single walled system.

Department of Historic Resources had no concerns.

Department of Highways and Transportation had no concerns.

Department of Health - Westman Region comments were:

1. The Director's Order should address the following:

  1. appropriate collection and transportation of used oil to the facility.
  2. primary and secondary containment measures in the event of a spill so as to protect surface/groundwater.
  3. clay berm construction?
  4. no drill logs are available.
  5. proximity to Minnedosa River.

2. Should ensure that an emergency response contingency plan is available for review.

Disposition:
The used oil will be collected in a double walled tank which isconsidered to be equivalent to a diked single walled system. The concerns of drilling logs and the closeness to the Minnedosa River have been addressed to the satisfaction of the Department.

Canadian Environmental Assessment Agency noted that after a review by all departments with a potential interest, application of the Canadian Environmental Assessment Act will not be required.

PUBLIC HEARING:

A Public Hearing will not be convened.

RECOMMENDATION:

The attached Draft Director's Order should be reviewed by the Director, finalized and then issued, with enforcement responsibilities assigned to the Environmental Operations Division.
