OVERVIEW:
The proposal was received on March 17, 1995 and dated March 8, 1995.
The proposal relates to the collection of used oil at the Rural Municipality of Wallace WDG in a double walled 4000 gallon tank The oil will be accepted from residents of the R Ms of Wallace and Archie as well as the Village of Elkhorn. The collected used oil will be sent by Licenced Carrier to a recycling facility or disposal facility.
After internal review, the proposal was advertized in the Virden Empire Advance on July 2, 1996, and also placed in the following Public Registries: Main Registry, Eco-Network, Border Regional Library and the Centennial Public Library.
The closing date for public comment was July 24, 1996
The proposal was sent to TAC on June 24, 1996, with a response closing date of July 24, 1996.
COMMENTS FROM THE PUBLIC:
There were no comments received from the public in response to the advertizement.
COMMENTS FROM THE TECHNICAL ADVISORY COMMITTEE:
Manitoba Environment, Environmental Operations Division, Park West Region had no concerns, but recommended that the terms and conditions identified in the Draft Operating Order that has been prepared by the Dangerous Goods Section of the Winnipeg Region be used as licencing conditions.
Manitoba Environment, Environmental Management Division, Terrestrial Quality Management noted that there is a risk of soil contamination from spills that may occur when the public is delivering oil to the facility, and when the haul trucks are loading from the tank. To minimize the risk of spillage to the soil, it is recommended that a sealed concrete pad be installed, for private vehicles and haul trucks to park on for unloading and loading respectively. This pad should also extend under the filler port of the tank, to intercept any spills that may occur during used oil transfer operations.
Manitoba Environment, Environmental Management Division, Water Quality Management noted that there is very little information with regard to water quality impact assessment. However, since the Waste Disposal Grounds is newly licenced, it is assumed that the location met any water quality concerns. It was suggested that the following conditions should be addressed in the Order:
- A berm or dike be constructed around the aboveground tank to contain the volume of the tank in the event of a rupture; and
- The area inside the dike should have a hydraulic conductivity of less than 10-7cm/sec. This should also include the area where the trucks are loaded for delivery to (the offsite disposal).
Department of Natural Resources had no concerns.
Department of Historic Resources had no concerns.
Department of Highways and Transportation had no concerns.
Department of Health - Westman Region comments were as follows:
- Order should address the following:
- appropriate collection and transportation of used oil to the facility including solvent testing prior to collection.
- primary and secondary containment measures in the event of a spill so as to protect surface/groundwater.
Also, there are insufficient details provided to determine whether containment measures are adequate.
- Should ensure that an emergency response contingency plan is available for review.
- Proximity of residences or populated areas is not specified.
P.F.R.A. Agriculture Canada - Noted that the following Mitigation Measures should be carried out and then there would be no need for a Federal environmental assessment under the Canadian Environmental Assessment Act.
Mitigation Measures:
- purchase of a double-walled steel storage tank that meets Manitoba Environment approved standards;
- tank to be installed to manufacturer's and Manitoba Environment's specifications;
- tank to be located in a lockable compound;
- deposit of waste oil into the tank to be monitored by staff at the site; and
- tank to be monitored for leaks by regular tank inspections and according to Manitoba regulations.
Canadian Environmental Assessment Agency - Noted that although the waste disposal ground was financed with infrastructure money, the oil collection facility is not financed federally.
The concerns of Terrestrial Quality Management and Water Quality Management of Manitoba Environment and P F R A, Agriculture Canada were addressed in the Order. The concerns of Manitoba Health were discussed with and addressed satisfactorily by the Applicant. The recommendation by the Park West Region, Manitoba Environment that the terms and conditions of the Draft Operating Order be used as licencing conditions was considered in drafting the Director's Order, but all terms and conditions of the Draft Operating Order were not used. The Draft Operating Order is not yet accepted as policy by the Department.
PUBLIC HEARING:
A Public Hearing will not be convened.
RECOMMENDATION:
The attached Draft Director's Order should be reviewed by the Director, finalized and then issued.
