IN ACCORDANCE WITH THE MANITOBA ENVIRONMENT ACT (C.C.S.M. c. E125)
THIS LICENCE IS ISSUED PURSUANT TO SECTIONS 11(1) AND 14(2) TO:

THE PROVINCE OF MANITOBA REPRESENTED BY THE MINISTER OF HIGHWAYS AND GOVERNMENT SERVICES; the "Licencee"

for the construction, operation and maintenance of the Development being a winter road linking Tadoule Lake, Brochet and Lac Brochet with Provincial Road 394 near Lynn Lake and in accordance with the Proposal filed under The Environment Act on January 9, 1997, and the Notice of Alteration filed by the Department of Highways and Government Services on January 13, 2000, and subject to the following specifications, limits, terms and conditions:

GENERAL TERMS AND CONDITIONS

This Section of the Licence contains requirements intended to provide guidance to the Licencee in implementing practices to ensure that the environment is maintained in such a manner as to sustain a high quality of life, including social and economic development, recreation and leisure for present and future Manitobans.

  1. The Licencee shall, during construction, ensure that any temporary fuel storage areas established for the construction of the Development are located a minimum distance of 100 meters away from waterbodies including wetlands and ensure the storage areas comply with the requirements of Manitoba Regulation 97/88R - Storage and Handling of Gasoline and Associated Products. Permanent fuel storage facilities shall not be established in conjunction with the Development.

  2. The Licencee shall ensure that all used petroleum products and other hazardous wastes generated by the machinery used in the construction and operation of the Development are collected and disposed of in accordance with Manitoba Conservation and legislative requirements.

  3. The Licencee shall, during the full term of the construction and operation of the Development, cleanup and deposit all non hazardous waste and debris from the construction and operation at a disposal ground operating under the authority of a permit issued pursuant to Manitoba Regulation 150/91 respecting Waste Disposal Grounds.

  4. The Licencee shall ensure that the Development is constructed and operated as a winter road to serve the Sayisi Dene First Nation at Tadoule Lake, and the communities of Brochet and Lac Brochet. Any other uses will be considered to be an alteration to the Development and the appropriate Notice of Alteration requesting approval shall be filed with the Director.

  5. The Licencee shall, prior to construction, provide a copy of this Licence to the contractor involved in the Development.

SPECIFICATIONS, LIMITS, TERMS AND CONDITIONS

  1. The Licencee shall ensure that the exact alignment of the winter road is selected in order to minimize disturbance to environmentally sensitive areas.

  2. The Licencee shall, prior to construction, provide a copy of a large map detailing exact alignment of the winter road including the number and location of stream crossings to the Manitoba Conservation Northeastern Regional Office in Thompson.

  3. The Licencee shall, prior to construction, obtain any required work permits from Manitoba Conservation.

  4. The Licencee shall limit any clearing of the right-of-way to a maximum width of 40 feet along all segments of the road where safety sight lines are adequate.

  5. The Licencee shall, prior to construction start-up, instruct the on-site project construction supervisor to ensure that no private or Crown lands, other than the land required for the Development, will be affected by the construction of the Development.

  6. The Licencee shall cut and pile merchantable timber along the right-of-way as directed by Manitoba Conservation.

  7. The Licencee shall dispose of all cleared material other than merchantable timber as directed by Manitoba Conservation.

  8. The Licencee shall, during construction, adhere to the general recommendations on design, construction and maintenance of temporary stream crossings as specified in the Manitoba Conservation guidelines titled Recommended Fish Protection Procedures for Stream Crossings in Manitoba, May 1996. Permanent stream crossings shall not be permitted.

  9. The Licencee shall locate ice bridges at temporary stream crossing sites with gently sloping banks to minimize cuts to watercourse banks.

  10. The Licencee shall, during construction, use only ice and snow to fill in narrow rivers and streambeds.

  11. The Licencee shall, during construction over streams where corduroy re-enforcement is required, use only clean delimbed logs tied together to facilitate removal of the stream crossing in the spring.

  12. The Licencee shall, prior to spring breakup, remove temporary stream crossings associated with the Development.

  13. The Licencee shall, prior to spring breakup, remove any debris left on the ice at stream crossing locations.

  14. The Licencee shall, prior to spring run-off, stabilize any cut stream banks and exposed soils to prevent erosion and until vegetation has been established and erodible soils have been controlled.

  15. The Licencee shall ensure that any vehicle left derelict on or close to the Development is removed and disposed of in accordance with all applicable legislation and regulation.

  16. The Licencee shall, within a period of 90 days of the closing of the road following the first full year of operation and in consultation with the Manitoba Conservation Northeastern Regional Office, submit a road use and caribou harvest monitoring plan to the Director. The plan shall contain the following information:
  1. usage of the winter road during the operating period including the number of individuals authorized to use the winter road and traffic volumes;
  2. operating and maintenance problems from the winter road identified during the operating period;
  3. details of monitoring caribou harvest including hunting violations and complaints;
  4. the need for an access control plan and other measures that may be required to mitigate any operating and hunting problems identified; and
  5. other matters as may be directed by Manitoba Conservation.

REVIEW AND REVOCATION

  1. This Licence replaces Environment Act Licence No. 2290 which is hereby rescinded.

  2. If, in the opinion of the Director, the Licencee has exceeded or is exceeding or has or is failing to meet the specifications, limits, terms, or conditions set out in this Licence, the Director may, temporarily or permanently, revoke this Licence.

  3. If, in the opinion of the Director, new evidence warrants a change in the specifications, limits, terms or conditions of this Licence, the Director may require the filing of a new proposal pursuant to Section 11 of The Environment Act.
