Legislation administered by the Public Service Commission:

The Public Service Act is the legislative framework for Manitoba's ethical and effective public service.

The Public Service Regulation, Parts 1-7 details the terms and conditions of employment for excluded employees, political activities regulations, and other matters for political staff including their terms and conditions of employment.

The Oath or Affirmation of Office Regulation comprises the oath of affirmation of office for both core public servants and political staff.

The Public Interest Disclosure (Whistleblower Protection) Act provides public servants and others who work for and with government, a clear process for disclosing concerns about significant and serious wrongdoing in the public service and provides employees with protection against reprisal. The Civil Service Act  [repealed on February 26, 2022] is the primary legislative framework for human resource management in the Government of Manitoba.

Conditions of Employment Regulation [repealed on February 26, 2022] under The Civil Service Act sets out the terms and conditions of employment for civil servants outside a bargaining unit.

Canadian Charter of Rights and Freedoms is one part of the Canadian Constitution which sets out those rights and freedoms that Canadians believe are necessary in a free and democratic society. Some of the rights and freedoms contained in the Charter are freedom of expression, mobility rights, equality rights, and freedom from unreasonable discrimination.

The Accessibility for Manitobans Act aims to achieve accessibility by preventing and removing barriers that disable people with respect to employment, accommodation, the built environment, and the delivery and receipt of goods, services and information.

The Employment Standards Code sets out the minimum working conditions for most workers in Manitoba which promote fairness in the workplace for employees and employers.

The Freedom of Information & Protection of Privacy Act (FIPPA) provides Manitobans and others with a right of access to records of public bodies, subject to certain specified exceptions, and with protection for personal information held by public bodies.

The Workforce Relations Act sets out basic certification, collective bargaining and dispute resolution mechanisms applicable to the various collective agreements negotiated between employers and unions within Manitoba.

The Manitoba Human Rights Code is paramount legislation and prohibits unreasonable discrimination which is based on group characteristics such as ancestry, nationality, ethnic origin, religion, age, sex, pregnancy and other gender determined characteristics, sexual orientation, marital or family status, source of income, political belief, and physical or mental disability.

The Manitoba Multiculturalism Act incorporates the fundamental principles of Manitoba's policy for a multicultural society: pride in our diversity; a determination to achieve equality of opportunity for all in our community, and a belief that the opportunities of the multicultural society can best be realized through partnerships among communities and with government.

The Personal Health Information Act (PHIA) provides individuals with the right of access to their personal health information and the right to have their personal health information kept private and held in the strictest confidence by those who maintain it

The Personal Investigations Act regulates how personal investigations are to be conducted regarding applications for credit, tenancy, employment or insurance.  In particular, it sets out how personal investigations such a reference checks are conducted, the consent/notification requirements and the right of access by applicants to information obtained.

The Worker Recruitment and Protection Act helps protect children and foreign workers from exploitation by talent and modelling agencies.
