Emergent Access to Court of King’s Bench

The Court of King’s Bench has instituted a new model for scheduling and case flow of Family Division matters that aims to resolve cases at the earliest point possible. Parties are encouraged to explore settlement of issues outside of court. If issues cannot be settled, parties must complete prerequisites prior to obtaining a hearing date before a judge.

The Court of King’s Bench has established that in limited circumstances, a party can apply to have the court hear their matter urgently. The circumstances in which the court will consider doing so include when there is:

  • an immediate or imminent risk of harm to a party or a child of a party
  • the removal of a child from Manitoba
  • the loss or destruction of property

In order to hear the matter, the court must agree that the request fits into one of these three categories and grant permission to the party to proceed. For more information about proceeding to court, please see Court System and Procedure section of this website.
